What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective November 24, 2020.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant pays $2,000.00 to the Landlord on or before December 20, 2021, and $500.00 to the Landlord on or before the 20th of each month commencing on January 20, 2022, up to and including January 20, 2023, and $416.00 to the Landlord on or before February 20, 2023. The Tenant shall also pay the Landlord the rent for the months of December 2021 up to and including February 2023 in full, on or before the first day of each corresponding month. If the Tenant fails to make any of the payments as required, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing under the order shall become payable with interest.
