What happened
The Landlords applied for an order to terminate the tenancy and evict the Tenants and Affected Party because the Tenants entered into an agreement to terminate the tenancy. The Affected Party requested a review of the order, alleging that it contains a serious error and that she was unable to reasonably participate in the proceeding.
The ruling
The Tribunal found that the Affected Party was a tenant under the Act and should have been included as a signatory to the N11 notice of termination. The previous order LTB-L-077704-22 was dismissed.
