What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because they, another occupant of the rental unit or someone they permitted in the residential complex have substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The Landlord's application for eviction of the Tenants is denied on the condition that the Tenants shall pay the outstanding balance for the water and sewage charges on or before September 19, 2021. If the Tenants fail to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenants within 30 days of the breach. The Tenants shall also pay the Landlord $186.00 for the cost of filing the application.
