What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord served a valid N8 Notice of Termination, and the Tenants were not present or represented at the hearing.
The ruling
The tenancy is terminated effective January 22, 2022, and the Tenants must vacate the rental unit by that date. The Tenants are ordered to pay the Landlord $10,450.81, which represents compensation for the use of the unit from September 1, 2021 to January 11, 2022, less the rent deposit and interest owed on the deposit, and less any payments the Tenants have made towards this amount. The Tenants must also pay the Landlord $101.92 per day for compensation for the use of the unit from January 12, 2022 until the date they move out. If the Tenants do not pay the full amount owed by January 22, 2022, they will start to owe simple interest at 2.00% annually on the outstanding balance.
