What happened
Landlord applied to terminate the tenancy and evict the Tenants due to the Tenants' use of the basement as a bedroom, which the Landlord claimed impaired the safety of the property. The Tenants filed a cross-application alleging the Landlord harassed, obstructed, coerced, threatened or interfered with them, substantially interfered with their reasonable enjoyment, and withheld or interfered with the supply of a vital service.
The ruling
The Tenants shall dismantle the bed frame and bed in the basement and not sleep in the basement. The Landlord shall be entitled to inspect the basement monthly for 12 months to confirm compliance. The Landlord and Landlord's agent shall not harass the Tenants regarding issues relating to the tenancy.
