What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not been seen in the rental unit for 3 months and the key fob had not been active since October 2021.
The ruling
The tenancy is terminated unless the Tenant pays $10,192 by October 31, 2022 or $11,542 by November 1, 2022 to void the order and continue the tenancy. If the Tenant does not pay, they must move out by November 1, 2022 and pay $7,592 plus daily compensation.
