What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, and the Tenant was in possession of the rental unit at the time of the application.
The ruling
The tenancy is terminated effective March 23, 2021. The Tenant must pay the Landlord $3,482.51, which includes rent arrears, NSF cheque charges, and the application filing fee, less the rent deposit and interest owed on the deposit. The Tenant must also pay $41.01 per day for each day of occupation starting March 24, 2021 until the Tenant vacates the unit. If the unit is not vacated by March 23, 2021, the Landlord may file the order with the Sheriff for enforcement.
