What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlords filed an L1 application for non-payment of rent and an L2 application for persistent late payment of rent. The Tenants had been paying rent late for several months.
The ruling
The tenancy is terminated effective August 16, 2020 if the Tenants do not pay the full amount owing by that date. The Tenants must pay $2,540 in rent arrears and costs, plus $38.63 per day in compensation for use of the unit after December 1, 2019, less the rent deposit and interest. If the Tenants pay the full amount owing by certain dates, the eviction order will be void and the tenancy will continue. If the Tenants fail to make timely rent payments for the next 12 months, the Landlord can apply to terminate the tenancy without further notice.
