What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the total rent required from March 1, 2019 to September 30, 2020.

The ruling

The Board found that the lawful monthly rent is $817.60 and the tenant owes $5,578.20 in arrears and costs to September 30, 2020. The Board ordered the tenant to pay the arrears and costs in a repayment plan over a two-year period, with the first payment due on November 15, 2020. If the tenant fails to make any of the payments, the landlord may apply to the Board for an order terminating the tenancy and evicting the tenant.
