What happened
Landlord applied to terminate the tenancy and evict Tenant due to rent arrears and an agreement to terminate the tenancy. The Tenant claimed to have paid the rent in cash, but the Landlord denied receiving any payments since May 2020. The Landlord also alleged the parties had signed an agreement to terminate the tenancy effective May 31, 2020.
The ruling
The tenancy is terminated effective January 15, 2021. The Tenant must vacate the unit by that date and pay the Landlord $12,231.64 in rent arrears and application fees, less the rent deposit and interest. If the Tenant does not pay the full amount by January 15, 2021, he will owe simple interest at 2% annually on the outstanding balance.
