What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit as of the hearing date.
The ruling
The tenancy is terminated effective November 1, 2020. The Tenant must pay the Landlord $11,774.30 in rent arrears and compensation, plus $175 in application fees, and $20.55 per day in compensation starting October 22, 2020 until the Tenant vacates. If the Tenant does not pay the full amount by November 1, 2020, the Tenant will owe interest and the Landlord can file the order for enforcement. The Tenant can void the order and continue the tenancy by paying $12,125 by October 31, 2020 or $12,750 by November 1, 2020.
