What happened

Landlord applied to terminate the tenancy and evict Tenant due to Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant, and wilfully or negligently causing undue damage to the premises. The Landlord alleged that on February 13, 2021, the Tenant caused a flood that damaged the Tenant's unit and 7 other units below.

The ruling

The tenancy is terminated effective December 10, 2021. The Tenant must pay the Landlord $5,524.11 for the damages caused by the flooding and $186 for the application filing fee, for a total of $5,710.11. If the Tenant does not pay the full amount by December 10, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement.
