What happened

Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords required possession of the rental unit for the purpose of residential occupation. The Landlords also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The Landlords' application was dismissed as they failed to establish that they served the N12 notice in good faith. The Tenant was ordered to pay back the one-month compensation that the Landlords had provided.
