What happened
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord is currently living abroad in Serbia and intends to move in the rental property and reside for at least one year with his family at the end of the tenancy (December 31, 2021).
The ruling
The Landlord's application is dismissed. The Landlord does not have the right to terminate the tenancy as the Landlord is not persuaded to reside at the rental property and the application is incomplete without the required affidavit.
