What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
The ruling
The Tenant is ordered to pay the Landlord $4,330 in rent arrears and costs, to be paid in monthly installments of $250 plus the regular monthly rent. If the Tenant fails to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant. The Landlord is ordered to pay the Tenant $1,876 in rent abatement and $1,500 in general damages. The Landlord is also ordered to pay a $6,600 fine to the Board. The Landlord's legal representative is ordered to pay a $700 administrative fine to the Board.
