What happened
The Landlord applied for termination and rent arrears. The Tenants had already vacated the unit a year prior to the hearing. The case involved significant counter-claims by the Tenants regarding overcrowding (15 people in a house), illegal rent increases, illegal entries, and the installation of surveillance cameras inside common living areas with audio/intercom capabilities used to monitor and direct the Tenants' behavior.
The ruling
The tenancy was terminated effective April 30, 2024. The Landlord was awarded $2,620.08, which is the balance of rent arrears and filing fees after deducting $5,335.48 in rent abatements for the Tenants (due to overcrowding, privacy invasion, illegal entry, and failure to provide receipts) and the rent deposit. Crucially, the Landlord was ordered to pay a $5,000.00 administrative fine to the LTB for 'blatant disregard' for the Act regarding indoor surveillance and illegal entries.
