What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant had been subletting the rental unit since December 2022, and the subtenant moved out at the end of April 2023. The Tenant claimed she delivered vacant possession of the unit at the end of April 2023, but the Landlord argued the tenancy should terminate on June 30, 2023.

The ruling

The tenancy is terminated as of May 31, 2023, the date the Tenant moved out. The Tenant shall pay the Landlord $261.05, which includes rent arrears up to May 31, 2023 and the application filing fee, minus the rent deposit and interest on the deposit.
