What happened

The Tenant filed a motion to set aside an ex parte eviction order that was issued after the Tenant breached a previous LTB order by failing to pay June rent. The Tenant admitted to the breach and stated she had been withholding rent since December 2024 due to maintenance issues. The Tenant requested to stay until September 30, 2025, as she could not afford to pay arrears and move at the same time. The Landlord agreed to the extension provided August rent was paid. Although August rent was paid late, the adjudicator found it fair to delay the eviction until the end of September.

The ruling

The Tenant's motion to set aside the eviction order (LTB-L-046044-25) is denied. However, the stay of the eviction order is extended and will be lifted on September 30, 2025, allowing the Tenant time to move. This extension was granted following the Tenant's late payment of August rent and her agreement to vacate by that date.
