What happened
The Landlord applied for compensation under Section 88.1 for out-of-pocket expenses incurred due to the Tenants' conduct. The Tenants failed to control their pets, allowing two cats to roam common areas in the condominium complex, and caused excessive noise. These actions led to the condominium corporation charging the Landlord for legal fees, late fees, and eventually registering a lien against the Landlord's rental unit.
The ruling
The Tenants are ordered to pay the Landlord $3,525.15 by October 7, 2025. This amount covers the out-of-pocket expenses the Landlord incurred from the condominium corporation (including legal fees and a registered lien) caused by the Tenants' inability to control their pets and noise levels, plus the application filing fee. If payment is not made on time, interest will accrue at a rate of 4% annually.
