What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

Unless the Tenant voids the order, the tenancy will be terminated effective January 3, 2025. If the tenant does not void the order, the tenants are ordered to pay $36,617.97 to the landlord, which includes rent arrears up to the hearing date, NSF charges, and the cost of filing the application. The Landlord is also entitled to daily compensation of $115.07 for each day of occupation starting November 5, 2024 until the unit is vacated. The Landlord is ordered to provide the Tenant with the garage door entry code by December 20, 2024.
