What happened

The Landlord applied to terminate the tenancy because they require the basement rental unit for their own residential occupation. The Landlord currently lives on the main floor but intends to move to the basement so their son and family can occupy the main floor for more space. The Tenant did not attend the hearing and has not yet deposited the mandatory compensation cheque provided by the Landlord.

The ruling

The LTB ordered the termination of the tenancy effective January 16, 2026, for the Landlord's personal use. The Tenant is ordered to pay $894.20 in compensation for the period between the notice termination date and the hearing date, plus a daily rate of $26.30 until they vacate. The Landlord was found to have acted in good faith with a genuine intent to reside in the basement unit.
