What happened

The Landlord applied for the termination of the tenancy and eviction of the Tenant due to non-payment of rent. The Tenant challenged the service of the N4 notice and requested an adjournment based on claims of frozen bank accounts and pending criminal charges related to the documentation provided to the Landlord. The Board found the notice was properly served and that the Tenant failed to provide evidence of his claims or a reasonable plan to pay arrears.

The ruling

The tenancy is terminated effective November 22, 2025, unless the Tenant voids the order by paying the arrears and costs. The Tenant is ordered to pay $7,569.51 to the Landlord for rent arrears up to the hearing date plus the application fee, plus daily compensation of $82.19 from October 9, 2025, until he vacates. Adjournment and relief from eviction were denied due to the Tenant's failure to provide evidence of his alleged criminal charges and frozen bank accounts.
