What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant claimed he was illegally evicted by the Landlord on March 1, 2023, but the Landlord stated the Tenant had signed an N11 agreement to terminate the tenancy on February 28, 2023. The Tenant refused to leave and the Landlord kept his belongings outside. The Tenant did not want to be restored to possession and intended to file his own application against the Landlord.
The ruling
The tenancy is terminated effective March 1, 2023, the date the Tenant ceased to be in possession of the rental unit. The Tenant shall pay the Landlord $1,613.42, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit.
