C.W.A.

What happened

The Tenant filed an application alleging that the Landlord harassed him, interfered with his enjoyment of the unit, and withheld vital services like electricity and heat. The Tenant claimed the Landlord was aggressive because he wanted to sell the property, restricted laundry access, and failed to address smoke from other tenants. The Tenant, who vacated the unit prior to the hearing, sought an $8,000 abatement. The Landlord did not attend the hearing.

The ruling

The Tenant's application for an order determining the Landlord harassed him and interfered with vital services is dismissed. The adjudicator found the Tenant's evidence was insufficient to prove the claims on a balance of probabilities, despite the Landlord's absence at the hearing.
