What happened

The Landlord applied to evict the Tenant for non-payment of rent. An initial ex-parte order was issued when the Tenant failed to attend the first hearing. The Tenant requested a review, which was granted on the condition she pay ongoing rent. At the new (de novo) hearing, the Tenant's request to raise issues under section 82 of the RTA was denied because she failed to comply with the interim order to pay ongoing rent. The Tenant agreed to vacate by June 30, 2025. The Board terminated the tenancy and ordered the Tenant to pay arrears.

The ruling

The tenancy is terminated as of June 30, 2025. The Tenant can void this order by paying $11,186.00 to the Landlord by June 30, 2025. If the Tenant does not void the order, she must move out by June 30, 2025, and pay the Landlord $8,626.05 for rent arrears and filing fees, less the rent deposit and interest. The Tenant must also pay $72.33 per day for each day she occupies the unit after June 26, 2025. The Tenant's request to raise maintenance issues was denied due to her failure to comply with an interim order to pay rent.
