What happened
The Landlord applied for the termination of the tenancy and eviction of the Tenants due to substantial rent arrears exceeding $52,000. Tenant 1 had previously served an N15 notice to terminate their interest in the joint tenancy due to personal circumstances and vacated the unit on January 31, 2025. Tenant 2 remained in possession but did not pay rent and failed to attend the hearing. The Landlord sought a monetary order capped at the Board's jurisdictional limit for the judgment, while the total required to void the eviction remains the full amount of the arrears.
The ruling
The tenancy is terminated effective August 11, 2025, unless Tenant 2 pays $56,141.00 by July 31, 2025, or $59,641.00 by August 11, 2025, to void the order. If the order is not voided, Tenant 2 is ordered to pay the Landlord $35,186.00, representing the capped jurisdictional limit plus the filing fee, after deducting the rent deposit and interest. Tenant 1's liability is limited to $34,955.00 for arrears accrued before her departure.
