What happened
The Landlord applied for an ex parte eviction order after the Tenant allegedly breached conditions of a previous LTB order. An order was issued without a hearing on July 10, 2025. The Tenant subsequently filed a motion to set aside that order. During the motion hearing, the Tenant admitted she had no evidence to support her claim that she had met the conditions and noted that she was already being evicted due to a separate order regarding rent arrears.
The ruling
The Tenant's motion to set aside the eviction order dated July 10, 2025, is denied. The stay of that order is lifted immediately, and the original order remains unchanged. The Tenant is subject to eviction.
