What happened
The Landlord applied for an order to terminate the tenancy, alleging that the Tenant substantially interfered with their lawful rights and committed an illegal act by renting the unit on Airbnb. This action violated condominium rules, leading to the condominium corporation threatening the Landlord with legal action. The Tenant was also found to be profiting by charging significantly more than the lawful rent.
The ruling
The tenancy is terminated effective June 7, 2025, and the Tenant must vacate the unit by this date. Relief from eviction was denied due to the ongoing nature of the Tenant's actions and the harm caused to the Landlord. The Tenant is ordered to pay the Landlord $452.71, which represents compensation for use of the unit less the rent deposit and interest. The Tenant must also pay daily compensation of $60.39 for each day they remain in the unit after May 22, 2025.
