What happened
The Landlord applied for rent arrears and NSF charges against Former Tenants. The Tenants had vacated the unit following an N4 notice. The application was amended from an L9 to an L10 because the tenants were no longer in possession at the time of filing. The Tenants attempted to raise maintenance issues (bedbugs, cockroaches, and repairs) under section 82, but these were largely dismissed due to lack of evidence, time-barring, or failure to comply with an interim order.
The ruling
The Landlord is ordered to pay the Tenants $682.07. This amount represents the credit due to the Tenants after their rent deposit and interest were applied against the minor rent arrears owing at the time they vacated. The Landlord was denied the application fee and NSF charges. Maintenance claims raised by the Tenants were dismissed.
