What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to rent arrears and NSF cheque charges. The Tenants did not attend the hearing but had paid a significant portion of the arrears since the application was filed. The Member found that while arrears remained, the Tenants had lived in the unit for twelve years and were paying current rent, leading to a postponement of the eviction date.

The ruling

The tenancy is terminated effective July 31, 2025, unless the Tenants pay $3,899.56 to void the order. If the Tenants do not pay and do not vacate, the Landlord can enforce the eviction through the Sheriff starting August 1, 2025. If the tenancy is terminated, the Tenants owe the Landlord $294.54 plus daily compensation of $58.03 until they move out.
