What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Landlord served a valid N4 Notice of Termination with termination effective January 20, 2023 due to rent arrears. The Tenants were in possession of the rental unit when the application was filed, but Josh D'alessandro had moved out prior to the hearing. Taryn Bailey attended the hearing.

The ruling

The tenancy shall continue, subject to the Tenant paying the outstanding rent arrears of $7,145.21 by September 15, 2023. The Tenant shall also pay new rent on time and in full as it comes due until the arrears are paid off. If the Tenant fails to make the payment as ordered, the Landlord may apply to the LTB to terminate the tenancy and evict the Tenant without further notice.
