What happened

The Landlord, a corporation, applied to evict the Tenant for non-payment of rent. At the hearing, the Tenant's attempt to raise maintenance issues under section 82 was denied due to failure to follow proper disclosure procedures. The Tenant admitted to the arrears but proposed a monthly repayment plan of $200. The adjudicator rejected the plan, finding it financially unfeasible for the Tenant and unfair to the Landlord. The eviction was ordered but postponed to give the Tenant, who has four young children, additional time to relocate.

The ruling

The tenancy is terminated effective June 30, 2025. The Tenant can void this order by paying $11,126.00 by May 31, 2025, or $12,786.00 by June 30, 2025. If the order is not voided, the Tenant must pay the Landlord $10,230.12 for arrears up to the hearing date, plus daily compensation of $54.58 from May 15, 2025, until moving out. A repayment plan was denied, but the eviction was delayed considering the Tenant's four children.
