What happened

Tenant applied for an order determining that Landlord collected or retained money illegally. The order was issued on February 14, 2025. The Landlord requested a review of the order, alleging that the Member erred in finding that the Landlord collected or retained rent in excess of the amount allowed by the Residential Tenancies Act, 2006.

The ruling

The Landlord's request for review of the order was denied. The Member found that the addition or removal of a party to an existing tenancy agreement does not create a new tenancy, and that the rent increase would have been an illegal rent increase contrary to the Residential Tenancies Act, 2006. The Member also found that the Landlord's interpretation of the Honsberger v. Grant Lake Forest Resources Ltd. case was unreasonable and inconsistent with the scheme of the Act.
