What happened
The Tenant applied for a determination that the Landlords gave a notice of termination for personal use (N12) in bad faith. The Tenant claimed the Landlord advertised rooms for rent shortly after she vacated. The Landlord maintained that he moved into the unit as planned, but his mother was unable to join him due to a significant decline in her health.
The ruling
The Tenant's application for a finding of bad faith was dismissed. The Board found that the Landlord successfully proved he occupied the rental unit as his primary residence shortly after the Tenant moved out and that the change in plans regarding his mother's move-in was justified by her medical condition.
