What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant for non-payment of rent. A former tenant was initially included in the application but sought to be removed, arguing he had vacated the unit in August 2021, long before the arrears accumulated. The Board determined that because the former tenant vacated before September 1, 2021, and more than one year had passed before the application was filed, the Board lacked jurisdiction over him. The application was amended to remove the former tenant. The primary Tenant failed to attend the hearing or pay the outstanding arrears.
The ruling
The tenancy is terminated effective July 22, 2025, unless the Tenant pays $11,138.52 to void the order. If the Tenant does not pay and fails to move out, the Landlord may enforce the eviction through the Sheriff starting July 23, 2025. Regardless of eviction, the Tenant is ordered to pay $5,935.64 to the Landlord, accounting for arrears, the application fee, and NSF charges, minus the rent deposit and interest. Daily compensation of $60.01 is required for each day the Tenant remains after June 4, 2025.
