What happened

The Landlord applied to terminate the tenancy because the Tenants failed to meet conditions in a previous Board order. Following a motion to set aside which was resolved, the Tenants requested a review of the subsequent order. The Tenants claimed they were unable to reasonably participate in the hearing because they were not provided with Tenant Duty Counsel (TDC) and lacked sufficient opportunity to present evidence.

The ruling

The request to review order LTB-L-089100-25-SA is denied. The Board found no serious error in the proceedings and ruled that the unavailability of Tenant Duty Counsel on the day of the hearing does not warrant a set-aside or review of the order. The original order remains confirmed and unchanged.
