What happened

The Landlord previously obtained an ex parte eviction order after the Tenant breached a consent order (LTB-L-021142-25) by short-paying an arrears installment by $5.08 and paying October rent one day late. The Tenant filed a motion to set aside the eviction order, citing her desire to preserve the tenancy and pay off arrears by December 2025. The LTB reviewed the Tenant's financial situation and determined that her income was insufficient to cover both current rent and the substantial arrears of $3,645.62 in a reasonable timeframe.

The ruling

The Tenant's motion to set aside the eviction order is denied. The Board found that although the Tenant wished to pay the arrears, her financial circumstances made it impossible to clear the $3,645.62 balance in a reasonable time. The stay of the eviction order is lifted effective December 5, 2025, providing the Tenant two weeks to find alternative housing.
