What happened
The Tenant applied for an order claiming the Landlord substantially interfered with her reasonable enjoyment due to pest issues (mice, roaches, bedbugs), lack of heat, a wall crack, mold, and a clogged sink. The Tenant claimed the Landlord failed to adequately address a bedbug infestation reported in November 2023, causing her to stay in hotels and incur expenses. The Landlord argued they responded reasonably and promptly once notified, and that the Tenant's lack of preparation and denial of access hindered treatment efforts.
The ruling
The Tenant's application alleging substantial interference by the Landlord due to pest issues and other maintenance problems is dismissed. The Board found the Landlord responded reasonably and promptly to the pest complaints once notified. The Tenant's own actions, including failing to prepare the unit for treatment and denying access, contributed to delays. Claims for other issues were unsupported by evidence.
