What happened

The Landlord applied to terminate the tenancy because the Tenant was persistently late in paying rent. Evidence showed that between February and August 2025, rent was paid late in almost every month, often by several weeks. The Tenant admitted to the late payments, citing financial and personal difficulties, but had brought the rent current by the time of the hearing.

The ruling

The LTB found that the Tenant was persistently late in paying rent. However, the Member granted conditional relief from eviction. The tenancy will continue if the Tenant pays the full monthly rent on or before the 1st of each month from February 2026 to January 2027. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee by January 16, 2026. If the Tenant misses a rent payment date, the Landlord can apply for an eviction order without further notice to the Tenant.
