What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenant pays $3,000 by July 20, 2023, $600 per month from August 2023 to September 2024, and the remaining $586 by October 2024. The Tenant must also pay all rent that came due between the hearing date and the order date by August 1, 2023, and pay the monthly rent in full and on time until the arrears are paid. If the Tenant fails to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
