What happened
The Landlord applied for termination of the tenancy and eviction based on rent arrears. The Tenant failed to pay rent consistently from June 2024. A technical error was noted on the N4 notice regarding the 'rent charged' and 'rent paid' columns; however, the adjudicator determined the notice substantially complied with the Act as the 'rent owing' amount was clear and did not prejudice the Tenant.
The ruling
The tenancy is terminated effective August 12, 2025, unless the Tenant pays $6,164.00 by that date to void the order. If the Tenant does not pay and fails to move out, the Landlord can enforce the eviction through the Sheriff starting August 13, 2025. The Tenant is ordered to pay a total of $3,749.85 after accounting for the rent deposit and interest, plus $36.85 daily compensation until moving out.
