What happened

The Landlord applied for the termination of the tenancy and eviction of the Tenants due to significant rent arrears. The Tenants failed to pay rent since early 2025 and did not attend the hearing despite being properly served. A preliminary issue regarding a one-day error on the N4 notice was addressed, with the Member ruling that it did not prejudice the Tenants.

The ruling

The tenancy is terminated effective July 29, 2025. The Tenants are ordered to pay $13,672.30 for rent arrears and the application fee. To void the eviction and continue the tenancy, the Tenants must pay a total of $15,186.00 on or before July 29, 2025. Daily compensation of $82.19 applies for each day the Tenants remain in the unit after July 14, 2025.
