What happened

The Landlord applied to terminate the tenancy after the Tenant breached a condition of a previous LTB order regarding rent arrears. An eviction order was initially issued without a hearing. The Tenant filed a motion to set aside that order, which was the subject of this hearing. The Tenant's representative argued that the Tenant recently found employment and needed more time to move, but provided no direct evidence of income. The Landlord noted the Tenant had not paid rent for eight months.

The ruling

The Tenant's motion to set aside the eviction order was denied. The LTB found that the Tenant had breached a previous conditional order and that the tenancy was no longer financially sustainable, with eight months of total non-payment. The stay of the eviction order was lifted effective July 11, 2025, allowing the Landlord to proceed with eviction.
