What happened

The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant attempted to raise several issues under section 82 (maintenance, interference, harassment), but these were not heard because the Tenant failed to provide a clear written description of the issues prior to the hearing, instead submitting a 117-page evidence package without a summary. The Tenant acknowledged the rent arrears but requested a payment plan, which was denied as the Tenant's testimony regarding financial capacity was inconsistent and poorly prepared.

The ruling

The tenancy is terminated effective November 30, 2025. To void the eviction, the Tenant must pay $10,636.00 (covering rent up to the end of November plus the filing fee, minus recent payments) by November 30, 2025. If the Tenant does not void the order, they must vacate by that date and pay the Landlord $7,577.07 plus daily compensation of $90.41 for any stay beyond October 28, 2025.
