What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord served a valid N8 notice on January 17, 2022, and the Tenants continued to pay rent late over the following 12 months, including not paying rent at all for some months.

The ruling

The tenancy is terminated effective April 23, 2023. The Tenants must pay the Landlord $18,186.00, which includes compensation for use and occupation of the unit from April 1, 2022 to March 31, 2023, and the cost of filing the application. If the Tenants do not vacate by April 23, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement.
