What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to persistent late payment of rent. An N8 notice was served alleging 9 instances of late or non-payment between December 2024 and November 2025. Tenant 1, an architect, explained that financial difficulties arose from a slowdown in the construction industry but asserted that his income was stabilizing and the other tenant was working full-time. The Tenants have two young children attending school in the area. The Board found the grounds for termination were met but granted relief from eviction under section 83, allowing the tenancy to continue provided the Tenants pay rent on time for the next 12 months.

The ruling

The tenancy continues on the condition that the Tenants pay the rent in full and on time for a period of 12 months, starting February 1, 2026, until January 1, 2027. The Tenants must also pay the Landlord $186.00 for the application filing fee by February 1, 2026. If the Tenants fail to meet the rent payment conditions, the Landlord may apply for an eviction order without further notice to the Tenants.
