What happened

The Landlord applied to evict the Tenant for breaching a previous LTB order by failing to pay rent on time. An eviction order was issued without a hearing. The Tenant then filed a motion to set aside that eviction order, which was heard. The Tenant admitted to the breach but explained it was due to a delay in receiving EI payments.

The ruling

The Tenant's motion is granted, and the eviction order issued on February 25, 2025, is set aside. The tenancy will continue, conditional on the Tenant paying rent on time and in full for 12 months (June 1, 2025 to May 1, 2026) and paying the Landlord $186.00 for the filing fee of the previous application. If the Tenant breaches the condition of timely rent payment, the Landlord can apply for eviction without notice.
