What happened

The Landlord applied to terminate the tenancy because he requires the rental unit for his son's residential occupation. The Tenants contested the application, alleging bad faith because they had previously refused an above-guideline rent increase requested by the Landlord.

The ruling

The tenancy is terminated effective July 31, 2025. The Landlord established a genuine intent for his son to occupy the unit. Despite the Tenants' claims of bad faith following a rejected rent increase, the Board found the Landlord's evidence persuasive. Discretionary relief was granted to delay eviction from the original January 2025 date to July 31, 2025, to accommodate the Tenants' medical and family needs.
