What happened

The Tenant filed a T1 application claiming that the Landlord illegally retained a rent deposit and failed to pay compensation related to an N12 notice. The Landlord argued that the deposit and compensation issues were previously resolved through another LTB order and Small Claims Court enforcement, where the deposit was applied to daily compensation owed by the Tenant. The Board determined that while the deposit retention and N12 compensation were indeed handled by a prior order, the Landlord failed to pay interest on the rent deposit for the duration of the tenancy.

The ruling

The Landlord is ordered to pay the Tenant $200.56 by September 23, 2025. This amount includes $152.56 for unpaid interest on the rent deposit and $48.00 for the cost of filing the application. Other claims regarding the return of the deposit principal and N12 compensation were dismissed as they were resolved in a previous legal proceeding.
