What happened
The Tenant filed T6 and T2 applications alleging that the Landlord failed to meet maintenance obligations and substantially interfered with her reasonable enjoyment through harassment. The maintenance claims involved a shower door, toilet issues, a dryer, and a refrigerator. The harassment claims involved the Landlord allegedly pressuring the Tenant to move because he wanted to sell the property. The Tenant had already vacated the unit on May 28, 2022.
The ruling
The Landlord and Tenant Board dismissed both the Tenant's T6 and T2 applications. The Board found the Tenant failed to prove the maintenance allegations or provide timely notice to the Landlord for certain issues. Other claims were dismissed as they fell outside the statutory limitation period. The harassment claims were dismissed because the Tenant failed to provide sufficient evidence that the Landlord's conduct was unreasonable or contrary to the Act.
